Terms of Service

Terms and Conditions

1st partnership
Our main concern is that you are satisfied with us. Therefore, our general terms and conditions (GTC) are the basis of a long-term, fair partnership. By placing an order, you agree to the terms and conditions.

2. Orders
Orders can be placed by phone +41 81 828 8000, by email at
info@bel-vino.ch or in one of our online shops at https://www.bel-vino.ch or https://www.wine-boooster.ch. Furthermore, due to the current situation, we are now offering a contactless wine delivery service. You can write to/use them under the following whatsapp numbers:  +41 79 109 4194 (Mr. Maurizio Scorza) and +41 78 611 7708 (Mr. Lutz-M. Lepperhoff). Or come to our vinotheque in Silvaplana, in strict compliance with the current hygiene measures specified by the BAG.

3. Protection of minors
According to legal regulations, alcoholic beverages may not be sold to young people under the age of 16 in Switzerland and Europe, and spirits may not be sold to minors under the age of 18. By placing an order with BelVino AG, you acknowledge these provisions and confirm that you are entitled to purchase.

4. Prices
The prices are in Swiss francs including 7.7% VAT (private customers). We reserve the right to make price or assortment changes as well as delivery options. Possible deliveries abroad are charged without VAT.

5. Discounts
5.1. Value discounts on the value of goods
Help to protect our environment. We reward your en bloc delivery (1 addressee) with the following attractive value discounts:

  • 2% from CHF 2000.00

  • 3% from CHF 3000.00

  • 4% from CHF 4000.00

  • 5% from CHF 5000.00

5.2. collection discount

6. Exchange/Return
We ask the buyer to check the condition of the received goods immediately upon receipt. After eight days, the delivery is considered approved. Tap wines or other defective wines from our general agents and from other specific wineries (see list in the appendix) can only be replaced within reasonable limits, ie up to a maximum of 1% of the original bottlings purchased and within a maximum of 12 months of delivery. For all rarities, as well as all items from the wine-growing regions of Bordeaux and Burgundy, no cone replacement is granted. They are sold as a "buyer's risk". In these cases, the buyer bears the risk of a possible defect such as a cork. Wines that have not been purchased from us cannot be refunded.

7. Terms of Payment
7.1. for deliveries within Switzerland and the Principality of Liechtenstein
Payment within 10 days net from the invoice date. Discount deductions are not recognized. Interest on arrears and reminder fees will be charged immediately. We reserve the right to supply customers who are not yet known to us against advance payment. The goods remain our property until full payment has been made. BelVino AG is entitled to have the retention of title registered with the competent authority at any time.

7.2. for deliveries via contactless home delivery service within the Upper Engadin region
are only made against prepayment of the invoice or payment with contactless EC, debit or credit card or the online payment service paypal. Manual credit card debits only against written confirmation from the owner via email.

8. Terms of Delivery
8.1. for deliveries within Switzerland and the Principality of Liechtenstein
Deliveries are made personally by BelVino AG (free within the Upper Engadin), by post or DPD (flat rate). In the case of subscriptions (e.g. Bordeaux, Burgundy), delivery is at actual costs. In the event of complaints about loss, damage, leakage, etc. during transport, the customer must contact the relevant transport company (Post, Vinolog, BelVino AG transporter) exclusively.

8.2. for deliveries abroad
The goods travel at the risk and expense of the buyer. Our sales staff will be happy to inform you about the modalities of international shipments and their current prices.

9. Subscriptions
The conditions published with the respective subscription (e.g. Bordeaux subscription) apply, which may deviate from the General Terms and Conditions (e.g. prices, discounts, transport costs).

10. Credit Checks
The buyer authorizes BelVino AG to obtain the information required for the processing of an order (applies exclusively to orders against invoice) from public authorities or from a central office for creditworthiness information.

11. Internet Links
All websites linked in any way to www.bel-vino.ch were checked for content and form before they were linked. Although we regularly call up the linked pages, we cannot rule out the possibility of content being published that is not directly related to our product range. In this case we would be grateful if you would inform the webmaster. We distance ourselves clearly from all abusive content and assume no responsibility for the correctness and content of linked sites.

12. Changes to the Terms and Conditions
These terms and conditions can be changed at any time and without prior notice.

13. Jurisdiction
The business activities of BelVino AG are based exclusively on Swiss law. Place of jurisdiction is Silvaplana.

Data protection declaration according to GDPR

1. BelVino AG operates the websites

and therefore responsible for the collection, processing and use of your personal data and the compatibility of data processing with the applicable data protection law.

Your trust is important to us, which is why we take the issue of data protection seriously and ensure appropriate security. Of course, we observe the legal provisions of the Federal Data Protection Act (DSG), the Ordinance on the Federal Data Protection Act (VDSG), the Telecommunications Act (TCA) and other applicable data protection provisions of Swiss or EU law, in particular the General Data Protection Regulation (GDPR) .

2. Calling up our website(s)

 

When you visit our website, our servers temporarily store each access in a log file. As with every connection to a web server, the following technical data is recorded and stored without your intervention:

  • the IP address of the requesting computer,

  • the name of the owner of the IP address range (usually your internet access provider)

  • the date and time of access

  • the website from which access was made (referrer URL), possibly with the search term used

  • the name and URL of the retrieved file

  • the status code (e.g. error message)

  • the operating system of your computer

  • the browser you are using (type, version and language)

  • the transmission protocol used (e.g. HTTP/1.1) and

  • possibly your username from a registration/authentication.

After 30 days, we automatically anonymize the recorded IP addresses so that no conclusions can be drawn about individual users.

This data is collected and processed for the purpose of enabling the use of our website (establishing a connection), ensuring system security and stability over the long term and enabling the optimization of our website, as well as for internal statistical purposes. This is our legitimate interest in data processing within the meaning of Article 6 (1) (f) GDPR.

The IP address is also evaluated together with the other data in the event of attacks on the network infrastructure or other unauthorized or abusive website uses for investigation and defense and, if necessary, used as part of criminal proceedings for identification and for civil and criminal proceedings against the users concerned. This is our legitimate interest in data processing within the meaning of Article 6 (1) (f) GDPR.

3. Using our contact form or online chat

You have the option of using a contact form or online chat to get in touch with us. For this we need the following information:

  • First and/or last name

  • E-mail address

  • notice/message

We only use this data and a telephone number you have provided voluntarily in order to be able to answer your contact request in the best possible and personalized way. The processing of this data is therefore necessary within the meaning of Art. 6 Para. 1 lit. b GDPR in order to carry out pre-contractual measures or is in our legitimate interest pursuant to Art. 6 Para. 1 lit. f GDPR.

4. Registration for our subscription newsletter

You have the option of subscribing to our newsletter on our website. Registration is required for this. The following data must be submitted as part of the registration:

  • salutation

  • first name and surname

  • E-mail address

The above data is necessary for data processing. We process this data exclusively to inform you about our products and services, to personalize the information and offers sent to you and to better tailor them to your interests.

By registering, you give us your consent to the processing of the data provided for the regular dispatch of the newsletter to the address you have provided and for the statistical evaluation of usage behavior and the optimization of the newsletter. This consent represents our legal basis for the processing of your e-mail address within the meaning of Article 6 (1) (a) GDPR purpose (cf. Section 16 below).

At the end of each newsletter there is a link that you can use to unsubscribe from the newsletter at any time. When unsubscribing, you can voluntarily tell us the reason for unsubscribing. After unsubscribing, your personal data will be deleted. Further processing only takes place in an anonymous form to optimize our newsletter.

5. Purchases on the internet (webshop)

If you would like to purchase goods via the "bel-vino.ch" web shop, we need the following data to process the contract:

  • payment method

We will only use this data and other information you provide voluntarily (e.g. separate delivery address, credit card information, additional requests or comments) to process the contract, unless otherwise stated in this data protection declaration or unless you have given your separate consent. We will process the data specifically in order to record your booking as requested, to provide the booked services, to contact you in the event of ambiguities or problems and to ensure correct payment.

The legal basis for data processing for this purpose lies in the fulfillment of a contract in accordance with Article 6 (1) (b) GDPR.

6. Purchases from our store

In principle, no personal data is collected from customers who make their purchases in stores. Exceptions to this are purchases on account, credit or debit cards.

Data from purchases made on credit or debit cards are carried out according to the guidelines of the PCI DSS (Payment Card Industry Data Security Standard). Credit card data is recorded anonymously for the sales staff and forwarded to Worldline Payment Services (formerly six payments group).

7. Order/Invoice Purchases

If you pre-order goods from BelVino AG and/or would like to purchase them on account, we need the following data to process the contract:

We will only use this data and other information you provide voluntarily (e.g. separate delivery address, credit card information, additional requests or comments) to process the contract, unless otherwise stated in this data protection declaration or unless you have given your separate consent. Furthermore, the technical partner "MySign AG" (see Sections 13 and 15) has access to the recorded data in order to ensure the secure operation of the web shop.

8.Cookies

Cookies help in many ways to make your visit to our website easier, more pleasant and more meaningful. Cookies are information files that your web browser automatically saves on your computer's hard drive when you visit our website. For example, we use cookies to temporarily save your selected services and entries when filling out a form on the website so that you do not have to repeat the entry when you call up another subpage. 9. Tracking Tools

a. General

For the purpose of the needs-based design and continuous optimization of our website, we use the web analysis service from Google Analytics. In this context, pseudonymised user profiles are created and small text files stored on your computer ("cookies") are used. The information generated by the cookie about your use of this website is transmitted to the servers of the providers of these services, stored there and processed for us. In addition to the data listed under point 1, we may receive the following information:

b. Creation of pseudonymised usage profiles

In order to provide you with personalized services and information on our website (on-site targeting), we use and analyze the data that we collect about you when you visit the website. e. Crazy Egg

We use the analysis service of Crazy Egg Inc. (16220 E. Ridgeview Lane, La Mirada, CA 9063, USA) on our website. Crazy Egg is a tool for analyzing user behavior. Using Crazy Egg, we can measure and evaluate the behavior of visitors to our website (e.g. mouse movements in the form of "heat maps", clicks, scroll height, etc.). For this purpose, Crazy Egg sets cookies on the end devices of the site visitors and can store data from site visitors such as e.g. B. G. StatHat

Our website uses the "Stathat.com" web statistics tool from Numerotron Inc. Chicago IL, USA. With "Stat Hat" the behavior of the site visitors can be tracked and the page views evaluated. The data collected is anonymous to us. We cannot draw any conclusions about your identity. The data is stored and processed by "Stat Hat" without a connection to the respective user being possible. We cannot influence this use of the data.

H. Google AJAX Search API

Java Script code from Google Inc., 1600 Amphitheater Parkway, Mountain View, CA 94043, USA (hereinafter: Google) is loaded on our website. If you have activated Java Script in your browser and have not installed a Java Script blocker, your browser may transmit personal data to Google. We do not know which data Google links to the data received and for what purposes Google uses this data. To prevent Google's Java Script code from being executed altogether, you can install a Java Script blocker (e.g. www.noscript.net).

i. Google Tag Manager

Use of “Google Tag Manager”: Google Tag Manager is a solution that marketers can use to manage website tags via one interface. The "Tool Tag Manager" itself (which implements the tags) is a cookie-free domain and does not collect any personal data. The tool triggers other tags, which in turn may collect data. Google Tag Manager does not access this data. 10. Email traffic

Based on Art. 957 ff OR, all business correspondence by email is archived in encrypted form for 10 years. The archived emails are automatically deleted after 10 years. The email data is stored in Switzerland.

11. Purchase of event tickets and vouchers

If vouchers or event tickets are currently available for purchase, customers have the option of purchasing and paying for event tickets and vouchers via the website. The purchase of event tickets for BelVino AG events requires user registration.

The legal basis for data processing for this purpose lies in the fulfillment of a contract in accordance with Article 6 (1) (b) GDPR.

12. Central storage and linking of data

We store the data specified in sections 4-9 in a central electronic data processing system. The data relating to you is systematically recorded and linked in order to process your bookings and process the contractual services. For this we use software from FIDUCIAL WINBIZ SA, Martigny (VS).

We base the processing of this data in the software on our legitimate interest within the meaning of Article 6 Paragraph 1 Letter f GDPR in customer-friendly and efficient customer data management.

13. Retention Period

We only store personal data for as long as is necessary to use the tracking services mentioned above and further processing within the scope of our legitimate interest. We keep contract data longer because this is required by statutory retention requirements. Storage obligations that oblige us to store data result from regulations on reporting rights, accounting and tax law. According to these regulations, business communication, concluded contracts and accounting documents must be kept for up to 10 years. If we no longer need this data to carry out the services for you, the data will be blocked. This means that the data may then only be used for accounting and tax purposes.

14. Disclosure of data to third parties

We only pass on your personal data if you have given your express consent, if there is a legal obligation to do so or if this is necessary to enforce our rights, in particular to enforce claims arising from the contractual relationship. This corresponds to our legitimate interest in offering an efficient and secure payment method (Art. 6 Para. 1 lit. f GDPR). PayPal carries out a credit check for various services such as payment by direct debit in order to ensure your willingness and ability to pay. This corresponds to PayPal's legitimate interest (according to Art. 6 Para. 1 lit. f GDPR) and serves to execute the contract (according to Art. 6 Para. 1 lit. b GDPR). Your data (name, address and date of birth, bank account details) will be passed on to credit agencies for this purpose. We have no influence on this process and only receive the result of whether the payment was made, rejected or pending verification.

Your data will be stored until the payment has been processed. This includes the time it takes to process refunds, claims management and fraud prevention. Twint

Twint is a Swiss company that enables its customers to process payments easily, securely and quickly. With this payment function, customers can pay by smartphone directly in the app. The amount will be charged directly to the account or the associated credit card. There are no additional costs.

When purchasing via Twint, the customer also accepts the Terms and Conditions of Twint.

15. Transfer of personal data abroad

We are entitled to transfer your personal data to third-party companies (contracted service providers) abroad for the purpose of the data processing described in this data protection declaration.
